Agreement Acceptance of Terms

By accessing or using the Pict AI website at pict.ai and our mobile applications (collectively, the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

Service Description of Service

Pict AI provides free AI-powered image generation and photo editing tools. The Service includes text-to-image generation, image-to-image editing, background removal, image enhancement, and other AI image processing features. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Free Access Usage Limits and Fair Use

The Service provides limited free usage of AI image tools. Each tool allows 2 free uses per IP address. After reaching the free usage limit, you will be directed to download the Pict AI mobile app for continued access. We reserve the right to modify usage limits at any time without prior notice.

You agree to use the Service only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use of the Service. Automated access, scraping, bot usage, or any form of programmatic access to the Service without our written consent is prohibited.

Content User-Generated Content

You retain ownership of images you upload to the Service for editing purposes. You represent and warrant that you have the right to upload and process any images you submit. You are solely responsible for the content you upload and generate using the Service.

For AI-generated images created from text prompts, you may use the generated images for personal and commercial purposes, subject to these terms. However, we make no representations regarding intellectual property rights in AI-generated content. The legal status of AI-generated images varies by jurisdiction, and you are responsible for understanding and complying with applicable laws in your jurisdiction.

We do not claim ownership of your uploaded images or AI-generated content. We do not permanently store user-generated content on our servers.

Restrictions Prohibited Uses

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
• Create deepfakes or manipulated images of real persons without their consent
• Generate content that infringes on copyrights, trademarks, or other intellectual property rights of third parties
• Produce content depicting minors in any inappropriate context
• Attempt to bypass content safety filters or usage limitations
• Use the Service for any purpose that violates applicable local, national, or international laws or regulations
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts, bots, or other programmatic means to access the Service
• Attempt to gain unauthorized access to our servers, systems, or networks
• Interfere with or disrupt the Service or servers connected to the Service

We reserve the right to block access to the Service for any user who violates these restrictions, without prior notice or liability.

AI Processing Third-Party AI Services

The Service uses Google Gemini API (via the Nano Banana AI engine) for image processing. By using the Service, you acknowledge that your content (images and text prompts) will be transmitted to Google for AI processing. Google's processing is subject to Google's own terms of service and privacy policies.

We are not responsible for the processing of your content by Google or any changes to Google's services, terms, or policies. If Google modifies or discontinues their API services, it may affect the availability or functionality of our Service.

No Warranty Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

We do not guarantee the quality, accuracy, or suitability of AI-generated images for any specific purpose. AI image generation technology has inherent limitations, and results may not always match your expectations or requirements. Color accuracy, detail precision, and content fidelity may vary.

Liability Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PICT AI, ITS OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICH IN THE CASE OF FREE SERVICES IS ZERO (0) DOLLARS.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Indemnification Your Responsibility

You agree to indemnify, defend, and hold harmless Pict AI, its operators, affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any rights of another party, or any content you upload or generate using the Service.

IP Rights Intellectual Property

The Service, including its design, code, graphics, logos, and trademarks, is owned by Pict AI and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

The Pict AI name, logo, and related marks are trademarks of Pict AI. You may not use these marks without our prior written permission.

Termination Account Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.

Law Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Romania. You consent to the jurisdiction of such courts and waive any objections to venue.

Severability General Provisions

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms constitute the entire agreement between you and Pict AI regarding the use of the Service and supersede any prior agreements between you and Pict AI relating to the Service.
